The Do's and Dont's of Copyright and Image Use in Artstor

Artstor Digital Library Collections

Permitted Uses (Do's):

  • Are contributed by museums and their rights are cleared by Artstor, and made available for subscription to other institutions (like the University of Mississippi). These images are governed by Fair Use.
  • Artstor's Terms and Conditions are clearly stated and apply to all images:
    • As an Artstor user you can use these image for research activities (classroom instruction, student assignments).
    • Public display or public performance as part of a noncommercial scholarly or educational presentation, such as a campus museum exhibition or conference presentation.
    • Non-public display of a student, faculty or curatorial portfolio.
    • In dissertations, provided reproductions are only made available for personal use, library deposit, or use solely within the UM institutional group.
    • On an ad hoc basis, sharing for the purpose of scholarly collaboration, comment or similar non-commercial educational or scholarly use.

Prohibited Uses:

  • Modifying, obscuring or removing any copyright, trademark or other intellectual property notices or licensing terms on images.
  • Making images available on a public website or unrestricted database, with exceptions for sharing of dissertations on third-party sites under Fair Use (ProQuest is protected, as governed by Fair Use).
  • Making Artstor images available to others except as described under uses outlined under the Artstor Terms and Conditions of Use.

Fair Use and Artstor:

  • Artstor will not prohibit you from using an image in a manner permitted under the Fair Use copyright law, as long as the use is not prohibited.
    • This includes claiming Fair Use when uploading dissertations to third-party sites (i.e. ProQuest).
    • Using Artstor images under Fair Use is done at your own risk; Artstor's legal clause does not cover these uses.

Public Images on Artstor

Public Collections

  • Are accessible to anyone library.artstor.org under "Public Collections".
  • These images come from partner institutions and are not governing by Artstor's indemnification clause. Artstor's Permitted and Prohibited Uses (see above) do not apply.
  • Each image and collection has its own rights statements made by the governing institution, which outlines use.
